Creator Agreement

This Creator Agreement applies when you use ScriptMyAds as a Creator. It adds to the Terms of Service and the Privacy Policy. Where they conflict, the order in the Terms applies.

1. What you offer

You may list services ("placements"): digital placements on X, Instagram, or LinkedIn (posts, reels, stories, and so on) and physical or in-person placements, each with a price you set in INR or USD, or marked "on request". Your listings must be accurate and something you can actually deliver.

2. Selection, orders, and fulfilment

We manually shortlist creators for brand campaigns; listing a service does not guarantee work. For each campaign you accept, you agree the deliverable, timeline, and fee before you start. You accept or decline a campaign offer within the window shown, deliver on the agreed timeline, and provide the revisions agreed.

3. Advertising disclosure (mandatory)

Every paid promotion you make through the Platform must be clearly disclosed, in line with the ASCI influencer guidelines and the Consumer Protection Act 2019 and its CCPA rules. You agree to:

  • Disclose any material connection (payment, free product, gift, trip, discount, affiliate arrangement, or relationship).
  • Use an approved label (Ad, Advertisement, Sponsored, Paid Partnership, Collaboration, Includes Paid Promotion, Affiliate, Free gift, Employee), placed up front and prominently, not buried in hashtags or only in your bio.
  • Turn on the platform's own paid-partnership tool in addition to the label.
  • For video and audio, keep the disclosure visible or audible for the required duration.
  • Follow our approval-before-post step: you submit content, we and/or the brand approve it, you post, then you submit the live link as proof.

You are responsible for your posts. Undisclosed or non-compliant promotion is a breach, may end your account, and you indemnify us for penalties caused by your non-compliance.

4. Your representations

You represent that: the content you deliver is your original work or properly licensed; it does not infringe anyone's rights; you have the right to grant the licences below; and your stated audience and metrics are genuine (no fake engagement or bought followers).

5. Content ownership and licences

You keep ownership of the content you create. For each campaign, you grant the Brand the licence agreed in that campaign's scope, and those rights vest only when the campaign fee is paid in full. You keep your pre-existing and background material, and grant the limited licence needed to use it within the deliverable. You grant us a non-exclusive licence to show and market your work on the Platform. If any deliverable is AI-generated, you will tell us so we can meet disclosure rules.

6. Payment, clearance, and taxes

  • You are paid the fee agreed for the campaign, in whole rupees or whole dollars, after your work is verified.
  • We hold the Brand's payment and release your share through our payment provider once the campaign is verified complete and the Brand's 7-day window to raise a problem has passed. See the Refund and Cancellation Policy, section 3.
  • If a campaign is cancelled or a valid dispute or chargeback arises before release, the disputed amount may be held or reversed pending resolution.
  • We may be required to deduct tax at source before paying you (for example on facilitated payments, or on benefits such as gifted products you keep), and to collect GST on your supplies through the Platform. You are responsible for your own income-tax and GST obligations.

7. Conduct

No fake engagement, bought followers, or misrepresented audience. Metrics you state must be honest. Breach may end your account and forfeit disputed payments pending review.

8. Term

You may stop listing or close your account at any time, subject to completing accepted campaigns and to the Data Retention Policy. Sections on payments owed, licences granted, disclosure indemnity, and conduct survive.
